IL MINISTRO DELLE INFRASTRUTTURE 
                           E DEI TRASPORTI 
 
  Visto il Codice della navigazione, approvato dal regio  decreto  30
marzo 1942, n. 327 e, in particolare, gli articoli 746 e 748, secondo
comma, recanti disposizioni sugli aeromobili equiparabili a quelli di
Stato, nonche' gli articoli 826 e 831 del medesimo Codice; 
  Visto  il  Codice  dell'ordinamento  militare  di  cui  al  decreto
legislativo 15 marzo 2010, n. 66; 
  Vista la legge 18 marzo 2008, n. 71, di ratifica e di esecuzione di
due  Protocolli   relativi   alla   Convenzione   internazionale   di
cooperazione per la sicurezza della navigazione aerea  (EUROCONTROL),
fatti a Bruxelles, rispettivamente, il 27 giugno 1997 e  l'8  ottobre
2002, e norme di adeguamento interno; 
  Visto il decreto del Presidente della Repubblica 15 marzo 2010,  n.
90,  e  successive  modificazioni,  recante  il  testo  unico   delle
disposizioni regolamentari in materia di ordinamento militare; 
  Visto il decreto del Ministro della difesa 19 dicembre 2012, n. 258
che assegna al Capo di stato maggiore  dell'Aeronautica  militare  la
competenza  in  materia  di  regolazione  tecnica,  certificazione  e
vigilanza  sugli  aeroporti  militari,  nonche'  la   responsabilita'
afferente lo svolgimento dell'attivita' di volo militare che in  essi
si svolge; 
  Visto il contratto n. 2559 USA, in data 23 dicembre  2011,  con  il
quale  il  Ministero  della  difesa  ha  noleggiato  per   un   anno,
eventualmente  rinnovabile,  a  decorrere  dal  16  aprile  2012,  un
aeromobile Gulfstream III tipo G-1159A, da assegnare  all'Aeronautica
militare per lo svolgimento di  attivita'  addestrativa  e  operativa
secondo le  modalita'  specifiche  concordate  tra  le  parti,  dalla
societa' «Lockheed Martin Corporation»; 
  Visto il certificato  di  aeronavigabilita'  relativo  al  velivolo
Gulfstream  III  tipo  G-1159  numero  di  serie  438  e  marche   di
registrazione N-30LX, di proprieta' della societa'  «Lockheed  Martin
Corporation», in uso all'Aeronautica militare; 
  Visto il documento Lockheed  Martin  con  il  quale  tale  societa'
accetta che l'aeromobile Gulfstream III tipo G-1159 numero  di  serie
438 e marche di registrazione N-30LX sia considerato  per  la  durata
del citato contratto n. 2559 USA aeromobile di Stato italiano; 
  Visto il messaggio ENAC, protocollo n. 50911/ETA del 20 aprile 2012
che  autorizza  l'attivita'  di  volo   in   Italia   dell'aeromobile
Gulfstream  III  tipo  G-1159  numero  di  serie  438  e  marche   di
registrazione N-30LX; 
  Vista la polizza assicurativa, stipulata in aderenza al Regolamento
(CE) n. 785/2004,  n.  AB062114  (Hull)  n.  SIHL1-485W  (Liability),
concernente il citato aeromobile con numero di serie 438 e marche  di
registrazione N-30LX; 
  Visto il decreto interministeriale 28 dicembre 2007, in materia  di
esenzioni inerenti le tariffe dei servizi  della  navigazione  aerea,
adottato in attuazione del Regolamento (CE) n. 1794/2006; 
  Vista la direttiva del Presidente del Consiglio dei ministri del 23
settembre 2011, recante la disciplina del trasporto aereo di Stato; 
  Visto il decreto del Ministro delle infrastrutture e dei  trasporti
21 giugno 2012, n. 209, adottato su  richiesta  del  Ministero  della
difesa, e in particolare l'art. 1, comma  1,  che  ha  equiparato  il
citato velivolo ad aeromobile di Stato, ai sensi  dell'art.  746  del
Codice della navigazione, fino al 16 aprile 2013; 
  Visto il decreto del Ministro delle infrastrutture e dei  trasporti
30 maggio 2013, n. 214, adottato su  richiesta  del  Ministero  della
difesa, che ha disposto la proroga degli effetti del  citato  decreto
21 giugno 2012, n. 209 fino al 16 aprile 2014; 
  Visto il decreto del Ministro delle infrastrutture e dei  trasporti
12 giugno 2014, n. 275, adottato su  richiesta  del  Ministero  della
difesa, che ha successivamente disposto la proroga degli effetti  del
citato decreto 21 giugno 2012, n. 209 fino al 16 aprile 2015; 
  Vista la nota del Ministero della difesa del 16 febbraio  2015  con
la quale viene richiesto di differire fino  al  16  aprile  2016  gli
effetti del citato decreto di equiparazione 21 giugno 2012,  n.  209,
come modificato dal decreto 30 maggio 2013, n. 214 e dal  decreto  12
giugno 2014, n. 275; 
  Vista la successiva nota del Ministero della difesa del  20  aprile
2015 con la quale si specifica che le citate attivita' in  cui  viene
impiegato  il  velivolo  sono  svolte  senza  alcun  fine  di  lucro,
esclusivamente e ininterrottamente  per  l'espletamento  dei  compiti
istituzionali assegnati alle Forze armate; 
  Vista l'ulteriore nota del Ministero della difesa del 5 giugno 2015
con la quale sono state trasmesse le note intercorse tra la Direzione
degli armamenti aeronautici e per l'aeronavigabilita' e  la  societa'
«Lockheed Martin Overseas Corporation», attestanti il perfezionamento
dell'esercizio dell'opzione prevista dal contratto n. 2559 USA per la
prosecuzione  dell'utilizzo  del  velivolo  in  argomento  da   parte
dell'Aeronautica militare fino al 15 febbraio 2016 e con la quale  e'
stato  comunicato  che  la  copertura  assicurativa,   di   esclusiva
competenza della «Lockheed Martin», verra' automaticamente estesa per
tutto il periodo in cui  prosegue  l'impiego  del  velivolo,  con  la
precisazione che nel caso di specie ricorrono i  requisiti  necessari
per l'adozione del decreto di equiparazione a velivolo di Stato. 
 
                              Decreta: 
 
                               Art. 1 
 
  Il termine di cui all'art. 1, comma 1,  del  decreto  del  Ministro
delle infrastrutture e dei trasporti 21 giugno  2012,  n.  209,  come
modificato dall'art. 1, comma  1,  del  decreto  del  Ministro  delle
infrastrutture e dei trasporti 12 giugno 2014, n. 275,  e'  differito
al 15 febbraio 2016. Fino a tale data, continuano  ad  applicarsi  le
disposizioni recate dagli articoli 1, comma 2, 2, 3 e 4 dello  stesso
decreto 21 giugno 2012, n. 209. 
  Il presente decreto sara' pubblicato nella Gazzetta Ufficiale della
Repubblica italiana.
